This privacy policy (“Privacy Policy”) describes how Whole In One International LLC and its subsidiaries, affiliates, and designees (collectively, “Company”, “we”, “us”, or “our”) collect, use and share personal information of users of the Company website https://wioliving.com (“Website”) or other online properties related to the Website or any associated software components (collectively, “Webservices”).  Company respects the privacy rights of our users and we are committed to protecting the information collected through our Webservices.  By downloading, installing, using, registering to, or otherwise accessing Company’s Webservices, you agree to this Privacy Policy and give explicit and informed consent to the storage, use, and processing of your personal data in accordance with this Privacy Policy.  

 

If you do not agree to this Privacy Policy, please do not download, install, use, register to, or otherwise access Company’s Webservices.  

 

Personal Information 

For purposes of this Privacy Policy, “Personal Information” means personally identifiable information that specifically identifies you as an individual.  The Personal Information Company may collect, process, and use may include, but are not limited to your name, gender, phone number, e-mail address, and/or any other identifier that permits the physical or online contacting of you, photo or other image, birthdate, address, friend connections, credit card information, and location.  Company may use Personal Information in connection with your use of, or participation in, membership registration for our Webservices, our contests, sweepstakes, promotions, games, surveys, forums, subscription registrations, content submissions, chats, bulletin boards, discussion groups, requests for suggestions, visitors’ requests for free products or services or additional information (including via e-mail to us) and in connection with other activities, services or resources we make available on any of our Webservices.  In all these cases, we will collect Personal Information from you only if you voluntarily submit such information to us.  Except as otherwise provided in this policy, we use current best practices to ensure that we never intentionally disclose any Personal Information about you as an individual user to any third party without having received your permission (through opting in or similar procedures), except as provided for herein or otherwise as permitted or required under law.  If you do provide us with personal information for any of these activities, we may use it to conduct the activity.  

 

We may also use cookie technology and Web beacons to improve your experience of these activities, including remembering your preferences, customizing the content and advertisements that you see or authenticate your access to your Personal Information.  In addition, in the event that your Personal Information is requested as part of our surveys, polls or promotions, such Personal Information may be added to your registration information.  We may also contact you about your account status, to confirm your registration, and regarding changes to this Privacy Policy.  If you give us your permission, we may also use Personal Information for internal or external marketing and promotional purposes.  On occasion, for example, we may send you e-mails to introduce a product or a service that we think might be of interest to the users of our Website.  For us to obtain your permission to send you this information, we will give you an opportunity to “opt in” at the time our request for your Personal Information is made.  If you do “opt in,” you may choose to “opt out” at any time, even after you have provided Personal Information, by following the procedures set forth below at the end of this Privacy Policy.  Please note, however, that under certain circumstances, if you initially do not choose to “opt in” or if you later “opt out,” you may not be eligible for certain benefits for which a name, e-mail address, telephone number or other personal identification information is needed.  

 

Exceptions to Releasing Personal Information  

Company collects and processes Personal Information on a voluntary basis and it is not in the business of selling your personal data to third parties.  Personal Information may, however, occasionally be disclosed in accordance with law and this Privacy Policy.  Company may institute the following exceptions to the policies regarding releasing Personal Information: Company may disclose your Personal Information to third parties when we have reason to believe that a disclosure is necessary to address potential or actual injury or interference with Company’s rights, property, operations, users or others who may be harmed or may suffer loss or damage, or Company believes that such disclosure is necessary to protect our rights, combat fraud and/or comply with a judicial proceeding, court order, or legal process served on Company (e.g. search warrants, subpoenas, statutes).  To the extent permitted by applicable law, Company will make reasonable efforts to notify you of such disclosure through our Website or in another reasonable manner.  Company may also disclose your Personal Information to third parties as required by law enforcement or other government officials in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose you or Company to legal liability.  Company is not liable for the acts and omissions of these third parties, except as provided by applicable law.  

 

Company will also release specific information in special cases, such as if there is an attempted breach of the security of the Website or a physical or property threat to you or others.  We may also transfer user information, including Personal Information, in connection with a corporate merger, consolidation, the sale of related assets or corporate division or other fundamental corporate change.  Company may provide access to your Personal Information to our contractors who are performing services for us in connection with our Website or Webservices that you have requested.  In addition, on occasion, we may collect Personal Information from you in connection with optional contests, special offers or promotions.  We will share such information with necessary third parties for the purpose of carrying out the contest, special offer or promotion.  Your participation in the contest, special offer or promotion constitutes your consent to such disclosure and use of such information.  

 

User Disclosure of Personal Information

Please note that if you give out Personal Information online—for example, on one of our public forums such as a message board, chat room, folder or chat IM feature—that information can be collected and used by third parties.  Although we strive to protect our users’ privacy, we cannot guarantee the security of information you post in these forums and have no control over how such third parties may use your information.  You disclose such information at your own risk.  You are responsible for maintaining the confidentiality of your information and password.  You shall be responsible for all uses of your registration, whether or not authorized by you.  You agree to immediately notify us of any unauthorized use of your registration or password.

 

Privacy of Minors

If you are under 16 years of age or a minor in your country of residence, please ask your legal guardian’s permission to use or access our Webservices.  Company understands that young people require special safeguards and privacy protections and we take children’s privacy seriously.  We strongly encourage parents and/or guardians to play an active role in their children’s online experience at all times.  Company does not knowingly collect any personal information from children below the aforementioned age and if we learn that we have inadvertently gathered personal data from children under the aforementioned age, we will take reasonable measures to promptly erase such personal data from our records.  

 

Safeguards 

Company follows generally accepted industry standards and maintains reasonable safeguards to attempt to ensure the security, integrity and privacy of the information in our possession.  Only those persons with a need to process your Personal Information in connection with the fulfillment of their tasks in accordance with the purposes of this Privacy Policy and for the purposes of performing technical maintenance, have access to your Personal Information in Company’s possession.  Personal Information collected by Company is stored in secure operating environments that are not available to the public.  To prevent unauthorized on-line access to Personal Information, Company maintains personal data behind a firewall-protected server.  However, no system can be 100% secure and there is the possibility that despite our reasonable efforts, there could be unauthorized access to your Personal Information. By using our Website, you assume this risk, and Company will not be liable for any misappropriation or theft of your Personal Information.  

 

Data Retention 

Company retains the data collected pursuant to this Privacy Policy for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.  Thereafter if the collected data is no longer needed for purposes specified in this Privacy Policy, Company deletes all aforementioned data in our possession within a reasonable timeframe.  We do not verify the correctness of personal data.  We may still retain some of the data to the extent such retention is necessary to resolve disputes, enforce Company user agreements, and comply with technical and legal requirements and constraints related to the security, integrity and operation of our Webservices.  If you reside or are located in a European Union member country or Switzerland, any Personal Information about you will be collected, used and retained in accordance with the General Data Protection Regulation (GDPR).  If you are a resident of a country subject to the GDPR and wish to exercise any of your rights regarding your data which has been collected or is being stored by Company, including access of your data, correcting inaccurate data, or deleting your data, please contact Company at info@omlifeliving.com.  

 

Correction and Deletion of Data

Company will provide you with reasonable access to any of your Personal Information which you have provided to us.  If you wish to access, update or correct any Personal Information we hold about you, or if you want us to delete any information about you that we have collected, you may contact us as set forth at the bottom of this Privacy Policy.  At your request, we will update, correct, or delete from our databases any personally-identifiable information we have about you.  

 

Cookies, Beacons, and Tracking 

Company’s Website may use “cookies” and other technologies such as pixel tags, clear GIFs and web beacons.  Company treats information collected by cookies and similar technologies as non-personal data.  E-mails and other electronic communications Company sends to you may contain code that enables us to track your usage of the communication, including whether the communication was opened and/or what links were followed (if any).  Company may combine that information to other information we have about you and use that information to improve our Webservices and/or provide customized communications to you.  

 

Third-Party Service Providers 

Company may use third-party service providers such as credit card processors, e-mail service providers, shipping agents, data analyzers and business intelligence providers.  Company has the right to share your personal data as necessary for the aforementioned third-parties to provide their services for our Webservices.  Company is not liable for the acts and omissions of these third-parties, except as provided by applicable law.  Further, the information you enter when making a purchase or online donation will be shared with payment processors, financial gateways and your credit card company to authorize credit card payments.  Such information may also be shared with necessary third-parties solely for the purpose of carrying out the transactions.  

 

Third-Party Terms and Conditions 

Please note that your access to and use of Company’s Webservices may be subject to certain third-party terms and conditions and privacy policies, including but not limited to application stores, mobile software platforms, on-line gaming platforms, social networking services and payment providers.  You recognize and agree that Company is not liable for any such third-party terms and conditions and their use of your Personal Information.  Company may, in its discretion, make available links through advertisements or otherwise enable you to access third party products or services.  Please note that, while using such products or services, you are using products or services developed and administered by people or companies not affiliated with or controlled by Company.  Company is not responsible for the actions of those people or companies, the content of their products or services, the use of information you provide to them, or any products or services they may offer.  The fact that Company is linking to those products or services does not constitute our sponsorship of, or affiliation with, those people or companies.  Please note that certain features our Webservices may offer, such as social networking, may use third party services to provide authentication for our Webservices with social networking ID.  When you register to join or use our Webservices from a third-party social networking system, certain personally identifiable user and/or membership data may be transferred automatically to and from Company and you hereby consent to the processing, using, combining, disclosing and retaining of such data in accordance with this Privacy Policy by Company. 

 

Changes to this Privacy Policy 

Company may change this Privacy Policy from time to time in order to address new issues, adhere to new regulations, and reflect changes on our website.  We will post those changes here so that you will always know our policies regarding what information we gather, how we might use that information and whether we will disclose that information to anyone.  Any changes to this Privacy Policy will be effective upon their being posted on Company’s Website.  Please refer back to this policy regularly.  Your continued use of our Webservices will signify your acceptance of the changes to this Privacy Policy.
